you want to use is 'indemnification' which basically means 'make me whole'. You don't care what the market value of the car is. You want another just like it is the approach. Challenge them to find the same exact car, and provide you with that. Show you are flexible in that you might accept a couple of other colors. And if the car does not have your upgrades, that you are willing to move yours to that car. Another option. Remember, the dealer has $ too. Go directly to the owner. Tell him what your cash needs are. Let him make the diff up out of his pocket over the insurance payment. No reason he cannot do that. To leverage the dealer, are there any 'investigative teams' in your area that work for local TV stations or newspapers?? You might want to imply that if he does not come across that he can watch himself explain on TV why your car was wrecked. Good luck man...
